News: Delay in Red Flag Rules Enforcement until August 1st!
May 1st, 2009 - The Federal Trade Commission issued an announcement that it will suspend enforcement of the new “Red Flags Rule” again.... this time until August 1st, 2009 to give creditors subject to FTC jurisdiction additional time in which to develop and implement written identity theft prevention programs.
Today’s announcement included a statement by the Federal Trade Commission that they will release a free template for use by organizations who know their customers personally. Others that create relationships with persons with whom they do not have personal knowledge will still need to put the full plan in place.

Any business wanting to do business with the above entities. Why? Part of the Red Flag Rules is "Vendor Management". In order to be a service provider or vendor for one of the above entities, a business must: Develop and implement a security plan, have a company policy on protecting information, and train ALL the employees who could have access to Non-public Information (NPI).
True Example: A local agency was wanting to do business with a local community bank. The bank was invited to visit the agency's office. The bank asked a couple of targeted questions to the prospective service provider, and determined that the bank could not do business with them because they did not have 'reasonable measures' in place to protect client info and their employees had not gone through training. By law, the bank could not use them for their services.
"Vendor Management - Another area where examiners are interested in is in the area of third-party service providers (TSPs), says Michael Jackson, spokesperson for the FDIC's regulatory compliance division. "Banks are not adequately overseeing the oversight of their third party service providers' (TSP) compliance with red flags regulation," hesays. "Even though they are not directly answerable to the regulation, these TSPs that hold information on these covered accounts or process transactions for these covered accounts need to be taking appropriate steps to prevent and mitigate ID theft."

Any business wanting to do business with the above entities. Why? Part of the Red Flag Rules is "Vendor Management". In order to be a service provider or vendor for one of the above entities, a business must: Develop and implement a security plan, have a company policy on protecting information, and train ALL the employees who could have access to Non-public Information (NPI).
True Example: A local agency was wanting to do business with a local community bank. The bank was invited to visit the agency's office. The bank asked a couple of targeted questions to the prospective service provider, and determined that the bank could not do business with them because they did not have 'reasonable measures' in place to protect client info and their employees had not gone through training. By law, the bank could not use them for their services.
"Vendor Management - Another area where examiners are interested in is in the area of third-party service providers (TSPs), says Michael Jackson, spokesperson for the FDIC's regulatory compliance division. "Banks are not adequately overseeing the oversight of their third party service providers' (TSP) compliance with red flags regulation," hesays. "Even though they are not directly answerable to the regulation, these TSPs that hold information on these covered accounts or process transactions for these covered accounts need to be taking appropriate steps to prevent and mitigate ID theft."
